                                              Assaulting a Traffic Agent Must Be a Felony

     Tell Governor Paterson Agents Deserve The Same Protections as  other Uniformed Heroes

          A Special Message From Local 1182 President James Huntley:

      After 15 years of struggle, both house of the Legislature have given final approval to Assembly bill 6011-  D, which would make it a felony to assault a Traffic Enfocement Agent in the course of thier offical duties. The bill, if signed into law, will send a strong message to all New Yorkers: That as hard-working law enforcement professionals who keep New York safe,we have earned the same protections and respect as police officers and firefighters.

 But first we need the Governor to sign this important legislation and make its NYS law. And you can help make it happen.

   A Letter From Local 1182 President James Huntley and the Executive Board

 

Dear Governor Paterson:

             I am writing to urge you to sign A.6011d into law. This important legislation won unanimous approval by each house of the Legislature and will have a dramatic impact on the New York City Traffic Enforcement Agent My union represents.

             New York City's Traffic Enforcement Agents ( TEAs) are law enforcement professionals employed by the new york City Police Department. They work Closely with, and supplement the effort of sworn police office and /or peace officers employed by the department. Teas enforce the vehicles and traffic law, as well as certain provisions of New York City's Administrative code. They also have significant responsibilities related to ensuring the smooth and orderly flow of traffic within the five boroughs. Like police offices, firefighters, corrections office and certain other personnel, TEAs are classified as part of New York City's elite uniformed forces, pursuant to local law.

           For decades, New York City's Various law enforcement agents have faced a major problem of on-the-job assault and harassment. As an example, from July 1 to September 15, 2007, Traffic Enforcement

Agents were victimized in the line of duty 83 times. This includes thirteen assaults committed against TEAs, two incidents of reckless endangerment, two incident of menacing, and one incident log larceny,among other crimes. These numbers mean that in just ten weeks, 3% of the workforce was victimized in the line of duty. On an annualized basis, this works out to roughly 15% of New York City's traffic agents becoming crime victims simply for doing their jobs.

           A major contributing factor into the violence plaguing TEAs and other law enforcement agents such as City Marshals ( who are also covered by A6011D are the woefully inadequate criminal penalties associated with these assaults. Currently, because New York City,s law enforcement agents are not a protected class under the law, a simple assault on one of them is a class A misdemeanor. To address this crisis, the City of New York has consistently supported legislative efforts to strengthen assault laws involving crimes against these public servants. A6011D is the culmination of those efforts.

           As the Mayor's office of State Legislative Affairs wrote in support of this legislation, "TEAs put their personal safety at risk every day when performing their duties wearing the uniform of the New York City Police Department. in order to do their jobs effectively, they must be reasonably assured that the law provides a deterrent to those who would commit criminal acts that could result in their injury. It is not only the safely of these public servants at stake, but the welfare of our citizenry, since their safety and quality acts of interference."

          While labor and management may not always agree, this is a circumstance where the employer and employee are in full accord. New York City's Traffic Enforcement Agents need and deserve, the protections afforded by A6011D.On behalf of the more than 2,000 Traffic Enforcement Agents employed By the New York City Police Department, I implore you to sign A6011D into law.

On December 29th 2006 there will be a 2% pay increase retro for six months. On 03/09/07 there will be a 4%  Incease also there will be a 0.34 that will go into annuities.
